GENERAL TERMS AND CONDITIONS – ONLINE SALES ​

ARTICLE 1 – APPLICATION OF GENERAL TERMS AND CONDITIONS FOR ONLINE SALES

These General Sales Conditions apply to customers (hereinafter individually referred to
as “Customer” and collectively as “Customers”) within the framework of the online
purchase of electronic tickets (hereinafter referred to as “E-Tickets”) and various oMers
via the service available on the website http://www.akproduction.ch/ and on the AK
Production app. The online sales service allows the Customer to purchase cinema
tickets or redeem gift vouchers/invitations for the screening of their choice, purchase
gift vouchers and/or AK Production Friends tickets through the Customer’s loyalty
account. Any purchase confirmed by the Customer via the website implies full, prior,
and unconditional acceptance of these General Sales Conditions. Commercial use of
AK Production website and app content, especially the online ticket sales channel,
without express written permission, is strictly prohibited.

ARTICLE 2 – TERMS OF USE OF THE ONLINE SALES SERVICE

2.1 – Purchase of Cinema Tickets, Gift Vouchers, or Redemption of Gift Vouchers
The Customer can use the online sales service to purchase cinema tickets or redeem
gift vouchers/invitations for one or more screenings at AK Production cinemas in
Switzerland. The Customer can also use the online sales service to purchase gift
vouchers. The Customer may purchase one or more cinema tickets or redeem gift
vouchers/invitations for all screenings available for sale, subject to availability and the
terms of use specified on the gift vouchers/invitations. The Customer may also
purchase gift vouchers to be sent to them by post. The Customer will be asked which
payment method they would like to use for the online sales service.
2.1.1 – Bank Card
The price applicable for purchasing an E-Ticket with a bank card is the price valid for the
selected screening, with payment being debited immediately. For gift vouchers, the
price published on the website is debited immediately. A maximum of 10 tickets or gift
vouchers can be purchased per category and transaction. Payment is made in Swiss
Francs, regardless of the origin of the sale. Additional fees may be incurred by third-party
providers.

ARTICLE 3 – PROHIBITION OF TICKET RESALE

The resale of all tickets purchased through AK Production platforms is prohibited.
Violations may result in the loss of the services associated with the tickets and potential
claims for damages or claims for profits against the person reselling the tickets and the
buyers of the same. Individuals who violate this provision may also be excluded from
future ticket purchases and refunds. AK Production accepts no liability for tickets not
purchased through its own sales channels. Such tickets do not entitle holders to attend
a screening, and any refund or liability claim is excluded. The use of tickets purchased
from AK Production for marketing or advertising purposes, such as in contests or
giveaways, is only permitted with express written permission. Violations may lead to
claims for damages by AK Production.

ARTICLE 4 – PRINTING/DOWNLOADING OF CINEMA TICKETS

Once payment has been confirmed, the Customer will receive a confirmation email with
the purchase receipt and their E-Ticket as a PDF attachment. Printing the ticket requires
a printer capable of printing on A4 size white paper. The Customer may choose to print
their E-Ticket in black and white or color. Customers with smartphones can present the
E-Ticket (QR code) directly. The responsibility for generating the ticket is transferred from
AK Production to the Customer by sending the confirmation email to the address
provided by the Customer. However, if the Customer loses their E-Ticket, they can
collect it at the cinema box oMice using their purchase receipt in accordance with the
conditions specified in Article 6. Reproduction, duplication, or creation of a counterfeit
E-Ticket is strictly prohibited. Only the first person presenting the E-Ticket will be
admitted to the cinema hall. It is assumed that this person is the rightful E-Ticket holder.
Anyone reproducing an E-Ticket or using a copy of an E-Ticket is committing an oMense.
The cinema may deny access to the cinema halls if it is known that multiple prints or
reproductions of a printable E-Ticket are in circulation or if access to the cinema halls
has already been granted to the holder of a print or reproduction.

ARTICLE 5 – TICKET CONTROL AND ACCESS TO SCREENS

Tickets are checked at the entrance to the screens using an electronic reader. The
Customer must present their printed E-Ticket on paper or with their smartphone. Access
to the screens is possible up to 10 minutes after the start of the film. For prices requiring
proof (e.g., identity card or age restrictions), this will be requested during the E-Ticket
check. If proof cannot be provided, access to the cinema halls will be denied. A QR code
may only be presented once for verification. E-Tickets cannot be resold.

ARTICLE 6 – CANCELLATION AND REFUND OF ETICKETS

6.1 – Cancellation by the Customer:
For events: Cancellations must be made in writing. Cancelling within 48 hours of an
event incurs a 50% charge. No refunds for cancellations on the event day or no-shows.
For cinema tickets: No refunds will be provided.
6.2 – Cancellation by the Cinema:
Subject to the application of Article 7 below (Force Majeure), in the event of the
cancellation of the screening, the cinema will oMer the Customer either an invitation
(excluding special screenings) or, depending on the circumstances, a refund of the order
in accordance with the conditions below. The Customer can choose their preferred
option, except in the cases listed below.
6.3 If a person in possession of an E-Ticket is denied access to the screenings due to a
breach of these terms or entry conditions, they are not entitled to a refund of the price
paid.

ARTICLE 7 – LOSS OF AN E-TICKET PURCHASED VIA THE ONLINE SALES SERVICE

In case of loss of an E-Ticket reserved via the website, the Customer can collect their
ticket at the cinema box oMice by presenting the ticket receipt of their online reservation.
However, if they made their reservation with a bank card, they can only collect their
ticket at the box oMice with the reservation number found in their confirmation email. To
receive their E-Ticket, the Customer must present the same payment method used for
the purchase and collect it no later than fifteen (15) minutes before the start of the
screening. After this time, no ticket will be issued, and the Customer will not be entitled
to a refund.

 

ARTICLE 8 – FORCE MAJEURE

AK Production GmbH shall not be liable if an event occurs which is considered force
majeure, including but not limited to:
• Force majeure (such as fires, explosions, earthquakes, droughts, tidal waves, and
floods);
• Pandemics, epidemics, or similar disease outbreaks, including quarantine orders or
other public health emergencies;
• War, hostilities (whether declared or not), invasion, acts of foreign enemies,
mobilization, requisition, or embargo;
• Rebellion, revolution, riot, military or usurped power, or civil war;
• Contamination by radioactivity from nuclear fuel or nuclear waste from the
combustion of nuclear fuel, radioactive toxic explosives, or other hazardous properties
of explosive nuclear assemblies or nuclear components of such assemblies;

• Riots, civil unrest, strikes, labor disputes, lockouts, or riots, unless limited exclusively
to employees of the supplier or its subcontractors;
• Terrorist acts or threats or rampage.
In the above cases where it is impossible to hold a screening for which tickets have been
sold, the Customer is not entitled to any refund or compensation of any kind.

ARTICLE 9 – CUSTOMER’S PERSONAL DATA

Personal data required for the provision of online sales services will be processed in
accordance with Swiss data protection law provisions. Personal data will be used for the
purposes stated at the time of collection, in connection with the conclusion or
fulfillment of contractual agreements (service delivery or product orders), for purposes
required by circumstances or legislation, and/or for marketing and analysis. Personal
data will not be disclosed or sold to third parties without prior consent.

ARTICLE 10 – COOKIES

The AK Production GmbH website uses cookies to function correctly. Cookies are text
files that are stored either temporarily or permanently on the Customer’s computer. The
Customer’s data is collected and stored anonymously, and the statistics of our website
do not contain information about individual users. Cookies store information such as
the time of a user’s visit, whether it is their first visit, and information about the page
from which the user comes. The anonymous data collected via cookies is sent to a
Google server in the USA and stored there. Google and Facebook/Atlas may disclose
this data to third parties, as required by law or if these third parties process this data on
behalf of Google. By using this website, the Customer agrees to the processing of their
data in the manner and for the purposes described above. Cookies can be removed or
disabled in the Customer’s browser at any time. Removing cookies may aMect the
availability of certain features.

ARTICLE 11 – DATA SECURITY

The transmission of data over the Internet is at the Customer’s own risk. Despite all
technical measures taken by AK Production GmbH, it is possible for data to be lost or
intercepted or manipulated by unauthorized third parties. The Customer is responsible
for taking appropriate security measures.

ARTICLE 12 – RIGHT OF ACCESS AND CORRECTION

The Customer can contact us at any time to find out what personal data is stored in our
files or to correct data that may be incorrect despite our eMorts and regular updates.

ARTICLE 13 – SECURITY AND CONFIDENTIALITY OF INFORMATION

The website complies with Swiss law on the confidentiality of users’ personal data.
Payment security:
• For payments by bank card, the website uses the latest technologies and has SSL
certification confirmed by a legally recognized authority.
• The data used (card number, expiration date, and security code) is transmitted in
encrypted form to a recognized software program (ADYEN), which communicates with
the banks used by the companies of the AK Production GmbH group.
Retention of payment data:
• Bank card data may be retained with the express consent of the Customer.
• The security codes of the bank cards are never stored.

ARTICLE 14 – APPLICABLE LAW – JURISDICTION DISPUTES

These General Sales Conditions are subject to Swiss law. Any complaints or disputes
arising from the interpretation or performance of these General Sales Conditions will be
submitted to the competent courts in accordance with general law. Jurisdiction is the
location of the cinema for which the ticket, voucher, or subscription was purchased.


Terms and Conditions for Prohibiting Recordings in the Cinema and the Resale or Online Posting of Films/Recordings*

1. Prohibition of Recordings

– Any form of audio and video recording during film screenings is strictly prohibited. – This includes the use of smartphones, cameras, tablets, or any other recording

devices.

 

2. Enforcement of the Ban

– Cinema staff are authorized to monitor compliance with the recording ban.
– Violators of this ban may be ejected from the cinema without a ticket refund.
– The cinema reserves the right to inspect recording devices if unauthorized recording is suspected.

 

3. Legal Consequences

– Unauthorized recordings and their distribution constitute copyright infringement and may be subject to criminal and civil prosecution.

– The sale or online posting of such recordings is strictly prohibited and will be prosecuted accordingly.

 

4. Liability and Damages

– The violator is liable for any damages caused to the cinema or rights holders due to unauthorized recordings.

– This includes legal fees, court costs, and potential claims for damages.

 

5. Acceptance by Entering the Cinema

– By entering the cinema and purchasing a ticket, guests agree to these terms and conditions.

– The terms and conditions are available for review at the ticket counter and on the cinema’s website.
